Film Desk Terms of Service

1. Agreement

These terms apply to the Film Desk desktop app and the Film Desk account website (together, the Service) provided by Evyxai (Evyx AI) [legal entity name to be added]. By downloading, installing or using the Service you agree to them.

2. Free trial

Film Desk includes a 14-day free trial that does not need an account. After the trial the app stays locked until you buy a licence. We may change or end the trial offer for new users.

3. Licence and price

Buying Film Desk gives you a personal, non-exclusive, non-transferable lifetime licence to use the app on up to 3 computers that you own or control at the same time. You can remove a computer in your account to free a slot for another.

The price is a one-time payment shown at checkout (currently listed as US$10). It is not a subscription. "Lifetime" means the life of the Film Desk product version line you bought, not your own lifetime [owner: confirm wording, and whether major new versions may be charged separately].

4. Payments and refunds

Purchases are sold and processed by Dodo Payments as merchant of record, under its terms and its checkout. Taxes may be added at checkout. Refund requests can be sent to developers@evyxai.com within [14] days of purchase [owner: confirm refund policy]. If a purchase is fully refunded, charged back or lost in a dispute, the licence is revoked.

5. Your account

Keep access to your email, Google or Apple account safe. You are responsible for activity on your account. One licence covers one account; do not share or resell it. We may suspend an account that is used to abuse the licence limits or the Service.

6. Your content

Your videos and projects stay on your computer and remain yours. We do not receive or claim any rights to them. You are responsible for having the rights to the material you edit and for backing up your files.

7. Acceptable use

Do not copy, reverse engineer or circumvent the licence checks of the app (except where the law allows), do not use the Service unlawfully, and do not try to disrupt the website or its API.

8. Updates and availability

We may release updates and change features. The app runs offline once licensed, but account features need the internet and may be unavailable from time to time.

9. Disclaimer and liability

The Service is provided "as is", without warranties of any kind to the extent the law allows. Video editing can fail, so keep backups of your originals.

To the extent allowed by law, Evyxai is not liable for indirect or consequential losses or lost data, and our total liability for any claim is limited to the amount you paid for Film Desk. Nothing here limits rights you have under consumer law that cannot be excluded.

10. Ending

You may stop using Film Desk at any time and request deletion of your account. We may terminate a licence for serious breach of these terms or if it is refunded or charged back.

11. Changes

We may update these terms. Material changes will be posted here with a new date. Continued use after a change means you accept it.

12. Governing law and contact

These terms are governed by the laws of [jurisdiction, to be added by the owner], and disputes go to the courts there unless the law gives you other rights. Contact: developers@evyxai.com.
